Code of Civil Procedure explained Article by Article – E2

This XXVII edition of the Code of Civil Procedure Explained explained article by article has been reviewed and updated in light of Legislative Decree 10/31/2024, n. 164 ( Correction to the Cartabia reform of the civil process , Legislative Decree 149/2022), which took into account the initial indications coming from the first instance judges and gave a definitive preference to the digitalization of procedural documents.

Further updates concern the intervention in the expropriation process from third parties (DL 19/2024, converted into L. 56/2024), always with a view to speed and digitalisation, and the so-called. Corrective to mediation and negotiation (Legislative Decree 216/2024), which updates Legislative Decree 28/2010 and DL 132/2014, converted into L. 162/2014.

These changes have led to a profound revision of the Explicated Code and also some choices, including that of explaining only the legislative text updated to the Cartabia Reform and to the Corrective , that is, the one actually applicable from 1 March 2023 even though the old procedure is still applicable for cases pending before 28 February 2023.

As with all the Codes in the Esplicati series, which are intended to facilitate the study and understanding of the legislative text, some didactic measures have been foreseen:

• clear and legible characters, for easier reading;
• definitions of keywords in bold, to facilitate understanding of the articles;
• explanatory notes, which complete the analysis of the legislative text;

• in-depth boxes on a grey background, to explain the ratio of the provisions;
• complementary laws, placed in the Appendix and accompanied by a brief introduction, to have a complete regulatory framework on procedural topics;
• form of the main documents to facilitate the first approach to judicial practice;
• analytical index to facilitate the search and understanding of the rules.

As structured, therefore, the Codes explained are essential for:

• university students, for studying law and preparing for exams;
• those who have to prepare for a competition with quiz tests where the normative data contained in the code is often the subject of the test;
• legal professionals, for quick consultation and practical application of the rules.
