The “Minor Criminal Procedure Code”, due to its characteristics, is a useful tool for students, legal practitioners (lawyers, magistrates and law enforcement) and for anyone who feels the need to consult a handy, practical code updated to the latest legislative developments. In fact, the code is published taking into account all those provisions that have modified both the code legislation and the complementary laws, some of which are reported in the Appendix. The edition therefore takes into account Legislative Decree 19-3-2024, n. 31 (Cartabia Corrective), which provides for supplementary and corrective measures of Legislative Decree 150/2022 aimed at resolving all those coordination problems that emerged in the first phase of application of the Reform; of Law 28-6-2024, n. 90 (Cybersecurity) which introduced and modified numerous provisions on computer crimes; Legislative Decree 29-6-2024, n. 89, conv. in L. 8-8-2024, n. 120 (Infrastructure Decree), the DL 4-7-2024, n. 92, converted into L. 8-8-2024, n. 112 (Prison Decree), which introduced the crime of embezzlement by distraction, also intervening on the procedural code. A further significant intervention was made with L. 9-8-2024, n. 114 (Nordio Reform) which, by repealing the crime of abuse of office, modified the criminal procedure code, affecting in particular the regulation of wiretapping and precautionary measures. A few days after the release of this code, two legislative decrees intervened: DL 26-9-2024, n. 131, converted into L.14-11-2024, n. 166 (Urgent provisions for the implementation of obligations arising from acts of the European Union and from infringement and pre-infringement procedures pending against the Italian State) regarding preliminary investigations and Legislative Decree 1-10-2024, n. 137, converted into Law 18-11-2024, n. 171 (Urgent measures to combat violence against healthcare, social healthcare, auxiliary and assistance and care professionals in the exercise of their functions as well as damage to goods intended for healthcare) regarding arrest in flagrante delicto.
