Systematic code of administrative procedure

The Systematic Code of Administrative Procedure was born from the need to systematize the rules applicable in the administrative process. Each article of the Code contains a brief commentary in which the connections with the other Books of the Code and with other provisions of law are highlighted (for example, with the Constitution and with the Code of Civil Procedure). The jurisprudential formative is recalled, above all, in the parts in which it is found to be decisive for the purposes of the correct interpretation of the rules. It was decided not to expressly include doctrinal references, to make the Code a more user-friendly and immediate tool to consult. However, also taking into account the extraction of the Authors, when the rules pose application questions to be resolved, the individual comments report the various exegetical theses in the field, with the aim of providing the jurist with a synthetic (but, we hope, exhaustive) aid in the interpretation of the rule. The aim is to present a Code that is able to provide legal practitioners with a vision of the administrative process that is coherent and coordinated with other forms of constitutionally provided jurisdictional protection, with attention also to supranational sources.
