Administrative Justice Course

The Administrative Justice Course is aimed at students, scholars and professionals of administrative law. It traces the administrative justice system in its many declinations, analyzing the actions (of annulment, of conviction, of assessment), the protections (of cognition, precautionary, executive) and the processes (ordinary and special, of first degree and of appeal, precautionary and executive). The administrative process must ensure the fullness and effectiveness of the protection of the substantial situation of legitimate interest. The protection, to be such, must then consist not only and not so much in the annulment of the illegitimate act, but rather in the establishment of the rule of conduct for the action of the Administration, requiring, in addition to the removal of the act and its effects, the ascertainment of the substantial claim corresponding to the legitimate interest, on which the condemnation of the PA to the satisfaction of the damaged interest is based.
