This volume offers an interdisciplinary contribution to the study of issues concerning AI and automated decisions. On the one hand, it presents an in-depth analysis of the computer-legal mechanisms underlying AI systems, outlining philosophical-legal classifications and categories useful for scholars and legal practitioners. On the other hand, it contributes to the debate on the legal categories most involved in the digital transformation of automated decisions, with particular reference to the AI Act.
The topics covered include fundamental concepts such as autonomy, democracy, the rule of law, “new” vulnerabilities and fundamental rights. These topics are analysed in their interactions with the legal categories most solicited by AI, such as “control” and “explainability”, which will be the subject of the next European regulation.
As a result of a critical reflection on these themes, the conclusions of the volume underline the need to develop tools for dialogue between human and algorithmic knowledge models.
In this perspective, the volume proposes a methodological synthesis called "Hybrid AI" which, in addition to promoting a better understanding and application of Artificial Intelligence technologies, stimulates cooperation between the autonomy of the human being and the computational capacity of the machine. The reflection develops in the analysis of the ethical and legal implications of these technologies following a human-centred perspective.
This work therefore provides a technological analysis, but also contributes to the broader debate on the need to adapt existing ethical-legal frameworks to address the challenges posed by AI. It thus offers useful tools for scholars, technologists and legal professionals who want to develop transversal skills in the vast domain of artificial intelligence.
