Public procurement 2025 after the corrective decree

The volume illustrates the numerous and important innovations introduced by the corrective decree to the Public Contracts Code pursuant to Legislative Decree 31.12.2024, n. 209. The decree modifies approximately 34% of the articles of the Code, and introduces new attachments.

In particular, the corrective measures address ten main macro-themes, including fair compensation, labor protection and CCNL, digitalization, qualification of contracting authorities, price review, consortia, protection of MSMEs, executive phase of the procurement contract, public-private partnership, technical advisory boards.

The provision represents a tool for further rationalisation and simplification of the discipline provided by the current public procurement code, which takes into account the main needs represented by the stakeholders in the sector, as well as the requests, presented at European level, for the modification and integration of some legal institutions, in order to resolve the infringement procedures still pending.

The corrective also intends to incorporate the main jurisprudential statements formed in the aftermath of the effectiveness of Legislative Decree 36/2023, thus ensuring a uniform application of the principles and rules. The discussion favors a practical-operational approach, with summary sheets of the main innovations for each topic.
