The right of withdrawal of the partner in capital companies

The volume analyses the instrument of withdrawal, which allows the partner to free themselves from the corporate bond when certain situations occur. After examining the legal nature, form and effectiveness of withdrawal, the author reviews the specific causes - legal, derogable and non-derogable, and conventional - both in joint stock companies and in limited liability companies. Furthermore, the hypotheses of a partner's exit from the company other than withdrawal are illustrated: exclusion, forfeiture and death.
