The new civil process. The appeals

Updated to Legislative Decree no. 149/2022 and Legislative Decree no. 164/2024 , the volume offers a comprehensive and in-depth analysis of appeals in civil proceedings, analyzing the effects of the reforms and guiding the reader through regulatory innovations and application criticalities.

Ample space is dedicated to the most significant case law through a survey of the different orientations for each topic, from consolidated interpretations to conflicts, with the indication and examination of the solutions, including the most recent ones, developed by the Joint Sections (for example, Cass., single section, 28 March 2024, no. 8486, on the late incidental appeal in proceedings concerning joint obligations, and Cass., single section, 5 November 2024, no. 28452, on the completion of notification by certified electronic mail in the event of non-delivery of the message due to a “full mailbox” or other cause attributable to the recipient).

The contribution of authors who combine academic experience and professional practice guarantees a systematic and operational examination of the institutions, with particular attention to the transitional discipline and the coordination of the new provisions with the general framework of the discipline.
