The preventive technical assessment

This work, now in its third edition, is updated to the innovations introduced by the Cartabia Reform and the most recent jurisprudence and confirms its approach, much appreciated in previous editions: it contains practical instructions for the request for preventive technical assessment, an institution that pursues the aim of preventing the inevitable dispersion of evidence, as the passage of time produces modifications both to places and to people; as well as for the request for preventive technical consultancy for the purposes of settling the dispute, provided for by art. 696 bis cpc

This tool, together with the need to preserve the evidentiary elements, promotes the interest of the parties in conciliation in the phase preceding the initiation of the trial on the merits.

Through jurisprudential itineraries, normative references and formulas, the main questions related to the application of the ATP institute are answered and, among others, questions are resolved in which its applicability to industrial law, administrative law, social security law and the field of medical liability is assessed, the application of which has undergone important changes following the entry into force of the Cartabia Reform.
