The VIII edition of the volume confirms that, despite the countless sector disciplines that intervene in the administrative action, the law of 7 August 1990, n. 241 maintains its connotation of general law on the administrative procedure that gives stability and concreteness to the activity of the public administration. This approach also allows citizens to find in the relationships with the public administration principles and values that now represent pillars confirmed in every sector also by the jurisprudence. The Judges, in fact, confirm the unifying and systematic value of law n. 241/90 recognizing the transversal importance of the discipline of the administrative action, as well as of the main issues connected to it from both an organizational and a provisional perspective. This edition shows how the jurisprudence has supported, in its rulings, the legislator's will to give the administrative procedure an acceleration on all phases in which evaluation profiles dependent on opinions and/or authorizations and/or no objections can determine situations that are permanent with respect to the interest, today increasingly significant, of concluding the administrative procedure within the legal timeframes. It is clear that overall all the measures in place do not only have the purpose of simplifying the action of the public administration, but are tools for greater guarantees of the private individual in the administrative procedure. The volume maintains the usual structure, with the subdivision article by article and the jurisprudence ordered by topic within the individual articles, thus confirming its characteristics of easy and immediate consultation. The jurisprudential collection is updated to September 2024, in order to provide the operator and individual citizens with a tool that is as complete as possible and that can be of assistance in (not always easy) relationships with the public administration.
