Legislative Decree 149/2022 significantly affects almost every aspect of civil procedural law. The legislative provision, in fact, intervenes on the entire CPC: starting from the increase in the value limits of the jurisdiction of the Justice of the Peace pursuant to Article 7, to the introduction of the possibility of suspending the enforceability of the foreign award during the pending opposition proceedings pursuant to Article 840, through the radical reform of the ordinary first-instance process; the general application of the forms of the simplified cognition process; the reform of the appeal and the appeal to the Supreme Court, with the inclusion of the new revocation for violation of the European Convention on Human Rights; the introduction of the new procedure in matters of persons, minors and families; the provision in the real estate expropriation of the new institute of "direct sale" ... But the reform is not limited to the Cpc, it extends to its implementing provisions (in which new rules are introduced and, above all, the telematic civil process is regulated in a unitary way in the new title dedicated to "digital justice"), to the other codes (Cc, Cp and Cpp and the related implementing provisions) and, above all, to many complementary laws of the Cpc, among which, albeit in an overall vision, it is necessary to remember the Legislative Decree 28/2010 and the Legislative Decree 132/2014, which regulate mediation and assisted negotiation. To facilitate the reader, each chapter of the volume opens with a "map", which contains a summary of the provisions that will then be examined in a more detailed and analytical way. The work is finally completed by numerous schemes that intend to offer a comprehensive and unitary vision of complex and articulated norms, so as to allow not only to grasp the most innovative elements of the innovations, but also to have an overall and synthetic vision of the reformed institutions. This volume collects the contributions published in n. 3, 4, 5, 6, 7, 8, 9, 10 and 11 of 2023 of Guida al Diritto, revised and updated - edited by Giuseppe Finocchiaro - to the latest changes made by Legislative Decree 13/2023 and to the Milleproroghe.
