The monograph aims to analyze the legal models of public law of data sharing in the European regulatory context, characterized by a dialectical tension between the protection of economic investments and the protection of competition, on the one hand, and the need for data circulation for public purposes and the protection of personal rights, on the other. It proposes an analysis of the provisions, generically defined as "obligation", in the current legislation, which impose a sharing of data by the relevant owners, identifying in them a legal case with clear contours - in terms of service obligations of general economic interest - as well as the foundation in public interests and subjective rights of constitutional relevance, such as freedom of science and protection of personal identity, with analogy to models already consolidated in administrative law (i.e. cultural heritage).
