Civil Procedure Memento

The 2024 edition of Memento Procedura Civile is a fundamental tool for the lawyer's activity because it examines in depth the first applications from the discipline introduced by the Cartabia reform of the civil trial .

It also contains the supplementary and corrective provisions of the reform itself reported in the corrective scheme to be published soon: these changes intervene in a timely manner to resolve some interpretative doubts that arose during the implementation phase.

The volume deals, first of all, with all the alternative procedures to the civil process , then examines the common rules of the process and therefore examines in depth the ordinary first instance procedure (before the court and the justice of the peace) and the simplified cognition procedure .

Ample space is dedicated to appeals (appeal, cassation and extraordinary remedies).

Individual sections are dedicated to: the enforcement process , with examples and summary tables; the labor process , which includes the analysis of disputes regarding assistance and compulsory social security; proceedings regarding possession , rental and family ; forms of consumer protection and the Pinto law.

This edition is enriched by a new appendix composed of tables with text opposite of the changes made by the corrective scheme to the code of civil procedure and to the related implementing provisions, referring to the paragraphs in which the new discipline is reported in highlighted boxes.

  • preliminary checks;
  • simplified cognition rite;
  • appeals;
  • debt collection through injunction.
• The innovations introduced by the PNRR on the subject of third party seizure (DL 19/2024 converted into L. 56/2024);
• THE regulations and implementing decrees provided for by the reform and in particular those relating to:
  • mediation (DM Giust. 24 October 2023 n. 150) and tax credits aimed at promoting mediation itself and assisted negotiation (DM Giustizia 1 August 2023):
  • criteria for clarity and conciseness of procedural documents (Ministerial Decree of Justice 7 August 2023 n. 110) with the establishment of a permanent observatory;
  • technical rules for the adoption of information and communication technologies in civil proceedings (DM Giustizia 29 December 2023 n. 217) which affects the notification of civil and extrajudicial documents via PEC;
  • identification of further categories of the register of technical consultants as well as the areas of specialization of each category (DM Justice 4 August 2023 n. 109);
  • operation of the database relating to judicial auctions (DM Giustizia 11 July 2023 n. 99) and the possibility for the creditor to access it to electronically identify the presence of seizable assets;
